1 . CONDITIONS OF BOAT UPON RETURN. The Renter shall return the boat on or before the termination date/time and at the specified location clean and free of garbage and debris in the same condition in which the boat was rented , including all parts and accessories. 2. DAMAGE DEPOSIT A Damage Deposit of $ 500 will be collected for each watercraft rented. During the return process, (docking, fueling, and cleaning) a K&S Marine Rentals LLC representative will inspect the watercraft for damages. The deposit will be applied towards the cost to repair any and all damage suffered to the Boat during the time of the rental. If the cost of damages/repairs exceeds the damage deposit, Renter agrees he/she is fully responsible for the remaining repair of the costs incurred to restore the boat to the condition it was in at the time the rental began. Should any damage exceed the damage deposit, Owner will provide an itemized repair bill, including lost rental time ( Lost Rental Time Begins With The Date OF The Itemized Repair Bill, And Stop When The Watercraft Is Once Again Available For Rental). The operator also understands that he/she is responsible for the retrieval and/or replacement of the watercraft, life jackets, or any safety items, if these items are in any way lost, stolen, or misplaced during the rental period. This repair bill, include loss rental time, and reasonable attorney fees must
be paid in full upon Users presentation of bill. User shall be responsible at and beyond the $500 damage deposit. 3. ACCEPTABLE USE Renter agrees and acknowledge that he/she will be the sole operator of the Boat, and will use the Boat in a carefully, safe and conscientious manner. Renter shall at all times observe and adhere to any rules and guidelines posted by owner, and any applicable laws or regulations of the state of California. Renter shall be responsible at all times for the for the safety of any and all passengers in and around the Boat. 4. UNSAFE USE If at any time Owner determines that renter has engaged in an unsafe or hazardous use of the Boat, Owner may immediately terminate the rental portion of the Agreement. If the rental is terminated for unsafe or hazardous use, the Renter will not be refunded his / her rental fee. Owner shall determine in its sole discretion whether any behavior or activity is unsafe or hazardous. 5. PROHIBITED ACTIVITIES Renter shall not violate any of the following rules and regulations during his/her operation of the boat/s: There is no smoking while in the boat, there are no drugs permitted on the boat, no pets permitted in the boat. 6. LIFE JACKETS REQUIREMENT Life Jackets required by all people during use of the boat. By the state of California children ages 13 and under are required to wear a life jacket at all times while on boat and boat is in motion. Violation of this law renters responsible will be cited. 7. BOAT CAPACITY Renters agree to not exceed person/weight capacity for any boat rented. Violation of this term shall immediately terminate rental with no refund.
